🌺 Terms & Conditions — Hamakua Sunrise Estate
Welcome to Hamakua Sunrise Estate, managed by Spark & Stay. By confirming your booking, you (“Guest”) agree to the following Terms & Conditions, which are legally binding and designed to protect your safety, privacy, and enjoyment, as well as the integrity of our property and community.
1. Acceptance of Terms
By completing a booking through Hamakua Sunrise Estate’s direct website or any authorized booking channel, the Guest affirms they have read, understood, and accepted these Terms in full.
2. Occupancy & Guest Verification
All individuals staying at the Property, including children, must be declared prior to check-in.
A valid government-issued photo ID is required for all adult guests and must be submitted no later than 48 hours before check-in.
The Host reserves the right to deny entry to undeclared or unidentified guests without refund.
No unregistered or unapproved visitors are allowed on the Property at any time.
Maximum occupancy is 20 guests.
3. No Parties or Unauthorized Gatherings
Parties, events, and large gatherings are not permitted without prior written approval from the Host.
Weddings, retreats, or other special events require a separate written contract and approval.
Unauthorized gatherings will result in immediate eviction, forfeiture of payment, and additional charges for damages as applicable.
4. Use of Property & Amenities
Use of amenities (fire pits, paddle boards, decks, ponds, etc.) is strictly at the Guest’s own risk.
Children must be supervised at all times, particularly near water features and equipment.
No smoking indoors. No illegal activity of any kind is permitted on the Property.
Pets are not allowed.
5. Guest Responsibilities
Guests are responsible for their own safety and the behavior of their entire group.
The Property must be returned in a clean, respectful condition:
All dishes must be rinsed or washed.
Trash disposed of in designated bins.
Equipment returned to original location.
Excessive mess or unwashed dishes/food waste may incur additional cleaning fees.
6. Damage, Liability & Charges
Guests are financially responsible for any damage, theft, or misuse during their stay.
The Host reserves the right to withhold or charge additional fees after checkout for damages or excessive cleaning.
Late check-out is charged at $50 per hour unless otherwise approved in writing.
The Host is not liable for personal injury, property loss, or travel disruptions due to weather.
7. Indemnification
Guests agree to indemnify and hold harmless Spark & Stay, its owners, managers, and employees from all claims, liabilities, or losses related to their stay.
8. Access & Enforcement
The Host, property manager, or trusted team members may access the Property if required for maintenance, inspections, emergencies, or to address safety or behavioral concerns.
While privacy is always respected, necessary entry may occur without prior notice.
Violations of these Terms may result in eviction without refund and financial accountability for damages.
9. Governing Law
This Agreement is governed by the laws of the State of Hawaiʻi. Disputes will be resolved in Hawaiʻi state courts.
10. Security Monitoring
For guest safety and property protection, exterior security cameras and/or noise monitoring devices may be in use. These do not infringe upon indoor privacy.
11. Wildlife & Environment Disclosure
The Property is in a tropical environment, and occasional contact with insects or wildlife may occur. While we maintain pest control routines, a completely pest-free environment cannot be guaranteed.
12. Natural Events
The Host is not liable for disruptions caused by natural events (storms, flooding, earthquakes, volcanic activity, etc.) that may impact travel or use of the Property.
13. Utility Outages
Temporary outages of water, electricity, internet, or other services may occur beyond the Host’s control. Refunds will not be provided for such outages.
14. Payment & Cancellation Policy
Payment is due in full at the time of booking.
All bookings are non-refundable. Cancellations, travel interruptions, or changes to plans will not be refunded.
At the discretion of the Host, future booking credits may be offered, but refunds are not guaranteed.
15. Age Requirement
The primary Guest must be at least 25 years old and present during the entire stay.
